Can I give Talaq to my Wife on Social Media or Text ?

Assalaamu Alaikum my Brothers & Sisters, Nikah is a sacred bond or contract of trust and justness where the Almighty is the witness, this bond, trust or contract CANNOT be broken with a simple text or even a phone call, as in Islam (The System of The Creator) has processes and procedures for every single act we do in our daily lives and shows us good governance on how to conduct ourselves throughout our lives.

Therefore at the Sharia Council we have all decided unequivocally that giving Talaq on Social Media, VIA the telephone and or Text is not permissible and therefore it is invalid, if we truly accept Islam as our way of life and the Qur’an as the manual of life then we MUST refer to it when we are about to conduct our affairs.

In Surah Talaq (65 Verse number 2. Allah SWT clearly says:

Then when they have ˹almost˺ reached the end of their waiting period, either retain them honourably or separate from them honourably. And call two of your reliable men to witness ˹either way˺—and ˹let the witnesses˺ bear true testimony for ˹the sake of˺ Allah. This is enjoined on whoever has faith in Allah and the Last Day. And whoever is mindful of Allah, He will make a way out for them

This is the command of Allah SWT that we have 2 witnesses so that later on it cannot be denied, as often  in todays society it is denied and there are no witnesses to verify either story.

It is also highly recommended that when all processes and procedures of mediation have been exhausted then the Talaq should be and must be in front of 2 witnesses who will also sign the document, this saves a lot of embarrassments afterwards and gives both parties closure.

May Allah SWT allow us to learn the deen and act upon it insh Allah Ameen Ya Rabb.
